Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and FreshLab ("Company", "we", "our", or "us") concerning your access to and use of our website, products, and services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
Definitions
Eligibility

Product Warranty
FreshLab products are warranted to perform as described when used according to our guidelines. This warranty covers manufacturing defects and does not cover damage caused by misuse, improper storage, or normal wear and tear. Our liability is limited to replacement or refund of the purchase price at our discretion.
EXCEPT AS EXPRESSLY PROVIDED HEREIN, PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Intellectual Property
All Content on our Services, including but not limited to text, graphics, logos, images, software, and trademarks, is the property of FreshLab or its licensors and is protected by intellectual property laws.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRESHLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR PRODUCTS OR SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless FreshLab and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of our Services.
Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our Services will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.
YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right under these Terms shall not constitute a waiver of such right.
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on our Services, constitute the entire agreement between you and FreshLab regarding the use of our Services.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our Services after changes become effective constitutes acceptance of the revised Terms.
